These Terms govern your use of StayFit, a fitness app developed by N3D LLC ("we," "us"). By downloading or using StayFit, you agree to these Terms. If you don't agree, please don't use the app.
StayFit helps you plan workouts, log training, and view your progress and recovery on your device. We grant you a personal, non-exclusive, non-transferable licence to use the app for your own, non-commercial use, subject to these Terms and the applicable app store's terms.
StayFit does not provide medical, health, or professional advice, and is not a substitute for a doctor, trainer, or physiotherapist. Any workouts, effort levels, recovery estimates, or other information are general and may not suit your circumstances. Always seek the advice of a qualified professional before beginning, changing, or stopping any exercise program, especially if you have a medical condition or injury, are pregnant, or are new to exercise.
StayFit is intended for users aged 13 and older. If you are under the age of majority where you live, you may use StayFit only with the involvement of a parent or guardian.
Some features require a paid subscription. Subscriptions are sold and billed by Apple through the App Store or by Google through Google Play, and auto-renew until cancelled. You manage, cancel, and request refunds for your subscription through your app store account, subject to Apple's or Google's policies. We do not receive or store your payment details.
You agree not to misuse StayFit, for example by reverse-engineering it (except as permitted by law), interfering with its operation, or using it in a way that breaks the law or the app store's terms.
StayFit, including its name, design, and software, is owned by N3D LLC and protected by intellectual-property laws. These Terms don't transfer any ownership to you. Your own logged data belongs to you and stays on your device.
StayFit is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose. We don't warrant that the app will be uninterrupted, error-free, or that any information it provides is accurate or suitable for you.
To the fullest extent permitted by law, N3D LLC will not be liable for any indirect, incidental, or consequential damages, or for any injury, loss, or harm arising from your use of StayFit or your reliance on any information it provides. Nothing in these Terms limits liability that cannot be limited by law.
We may update StayFit or these Terms from time to time. When we make material changes to these Terms, we'll revise the effective date above. Your continued use of StayFit after an update means you accept the revised Terms.
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules.
